(each, as applicable, referred to herein as “us,” “we,” “our” and their variants) collect, use and, share your personal data, including the rights you have and choices you can make regarding that personal data. Your privacy is important to us, and we recognize that you care about how your personal data is used.
This Privacy Policy applies to personal data collected when you access and use our website (www.anova.com), any other websites to which this Privacy Policy is posted, our applications and online platforms to which this Privacy Policy is posted, any mobile applications to which this Privacy Policy is posted, and other Internet-available content we make available to you (collectively, the “Services”), as well as to personal data we collect from or about you when you interact with us in other contexts as described below.
This policy does not apply to information collected by:
- Us offline or through any other means; or
- Our customers that they disclose to us to process on their behalf (unless they have indicated to you, through an agreement or otherwise, that your data is subject to our Privacy Policy).

We and our service providers may collect several types of information from and about users of our Services (some of which is considered “personal data” pursuant to applicable law), including:

Directly from you when you provide it to us (including when you register for an account, create new accounts for Authorized Users, or request something from us);
Automatically as you navigate through certain portions of our Services, including when using online portals or websites, through the use of cookies, web beacons, other tracking technologies (including information about your network or computing device) and analytics services;

Automatic Data Collection Technologies
As you navigate through and interact with some parts of our Services, we and our service providers may use automatic data collection technologies to collect certain information about you, your equipment, your technology providers, and your activities, including:
- Details of your visits, including traffic data, browsing patterns, location data, logs, and other communication data and the resources that you access and use; and
- Information about your device and about your internet connection and service provider, as set forth above.
The information we collect automatically may be statistical data and may also include personal data, or we may maintain it or associate it with personal data we collect in other ways or receive from third parties. This information enables us to:

When you visit or leave the applicable portion of the Services (e.g., online portal or mobile application) by clicking a hyperlink or when you view a third-party Services that includes our plugins or cookies (or similar technology), we may automatically receive the URL of the Services from which you came or the one to which you are directed.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. Note that while you can set your browser to not allow cookies, we may not be able to honor that request, and may track your activity and collect information about you and your online activities even when the browser is set to “do not track”;
- Flash Cookies. Certain features of the Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation. Flash cookies are not managed by the same browser settings as are used for browser cookies and you may not be able to shut down our collection of and use of information through this technology;
- Web Beacons, Pixels and Tags. Pages of our portals or websites and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity);
- Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with our portals or website, such as information about the links you click on;
- ETag, or entity tag. An ETag, or entity tag, is a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. It is one of several mechanisms that HTTP provides for web cache validation. These allow websites to be more efficient and not serve content again, when data is already cached and ready to view;
- Fingerprinting. Fingerprinting refers to the collection and analysis of information from your device, such as your operating system, plug-ins, system fonts and other data, for purposes of identification;
- Recognition Technologies. Recognition technologies refers to various technology features used by websites, including application of statistical probability to data sets, which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user); and
- Log Files. These track actions occurring on our portals or websites, and which help us collect your IP address, browser type, Internet service provider, the webpages from which you came or to which you go before and after visiting the Services, and the date and time of your visits.
Our devices also are designed to automatically transmit information that may be considered personal data in some cases, such as GPS coordinates and geolocation data, and we collect and process this data to provide our services, and also use it in our business (e.g., to understand where our customers and their customers are located, among other purposes). By using our devices, you consent to such collection and use.
How We Use Your Information

We do not sell any categories of personal data to third parties in exchange for monetary compensation. However, we use certain online tools, such as analytics services, on our Services or parts thereof, which allow our third party service providers to collect personal data about you (and this may be considered a “sale” under some laws). We may also disclose personal data to third parties for the purposes of providing marketing relevant to you, which may be considered “sharing” under the laws of certain jurisdictions.
Deidentified or Aggregate Data. In the preceding 12 months we did not share any personal information for cross context behavioral advertising purposes. We did not sell any personal information in this time period in exchange for monetary compensation, but we did use analytics services on our website, and such use may be considered a “sale” under some laws.

Some jurisdictions require that organizations have a “lawful basis” for processing or sharing personal data. We have several lawful bases for using and disclosing the information we collect for the purposes described in this privacy policy. Specifically:
- We have a legitimate business interest in processing your personal data, such as when you visit our Services and we analyze the data produced by your visit to assess the functioning of the Services, including when we aggregate it with other visitor data and such interests are not overridden by your privacy rights or interests; and we have a legitimate interest in processing your personal data to provide our services to our customers;

Do Not Track
Your browser and other mechanisms may permit you to send do not track signals or other similar signals via your browser settings to express your preferences regarding online trafficking. Due to a lack of standard for how do not track signals should work on commercial websites, we do not currently respond to such signals.
Cross-Border Transfers of Personal Data
We are a global company, with operations and offices in various countries around the world. If you reside outside the United States and use our Services, or otherwise provide or make available information to us, you acknowledge that your information may be transferred to and processed in the United States, which may not provide the same level of privacy protection as the laws in your jurisdiction.
Data Security
We have implemented measures intended to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure. However, you acknowledge and agree that some information will be transmitted over unencrypted lines of communication, such as when a GPS signal or geolocation data from our devices is sent over mobile data lines.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential.
Furthermore, the transmission of information via the internet is not completely secure. Although we try to protect your personal data, we cannot guarantee the security of your personal data transmitted through or collected through the use of the Services. Any transmission of personal data is at your own risk.
We are not responsible for circumvention of any privacy settings or security measures contained on the Services.
Children under the Age of Eighteen (18)
Our Services is not intended for children under eighteen (18) years of age.
We do not knowingly collect personal data from children under the age of eighteen (18). If you are under eighteen (18), do not use or provide any information on the Services or on or through any of its features or register on the Services, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.
If we learn we have collected or received personal data from a child under eighteen (18) years of age, we will delete that information.

- Access the data we hold about you and to get a copy of it, as well as learn whether or not your personal data are being processed by us;
- Object to our processing of your personal data for certain activities or purposes, or otherwise restrict us from processing your data (though such objection may prevent us from providing the Services to you or otherwise interacting with you);
- Withdraw your consent, when consent has been provided for certain processing activities (note that withdrawing your consent does not affect the lawfulness of any collection, processing, use, and/or disclosure undertaken prior to your withdrawal, but it may prevent us from providing the Services to you or otherwise interacting with you);
- Rectify or correct any data that is not accurate or not up-to-date;
- Obtain the erasure of your data under certain circumstances;

- Opt out of marketing emails, or, in some jurisdictions, the sale of personal data to third parties or sharing of personal data for cross-context behavioral advertising;

- Appeal our decision not to take action on a request to exercise one or more privacy rights.
If you submit a request pursuant to one of these rights, we will take steps to verify your identity prior to processing your request. We may not fulfill your request if you have not provided sufficient information for us to reasonably verify you are the individual about whom we have collected personal data. If you are a customer, we may use our existing account authentication practices to verify your request. If you do not have an account with us, we may request additional information about you. We will only use the personal data provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the personal data for another purpose.
You may be permitted by the law of your jurisdiction to use an authorized agent to submit a request. When we verify your agent’s request, we may verify both your and your agent’s identity and request documentation from you that authorizes your agent to make the request on your behalf. To protect your personal data, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.
If you choose to exercise these rights, we will not discriminate against you. However, exercising certain of these rights may render us incapable of providing the Services to you.
You may have the option to escalate concerns to the applicable privacy regulator in your jurisdiction. We request that you contact us if you have any complaints or questions about how we have processed your data, so that we may resolve privacy questions or concerns promptly and efficiency. California Residents
California Civil Code Section § 1798.83, known as the “Shine The Light” law, permits users of our Services who are California residents to request and obtain from us a list of what personal data (if any) we disclosed to third parties for direct marketing purposes in the preceding year, and the names and addresses of those third parties.
